The action was not filed In the district court until March, 1911 The defendant, In Its demurrer, contends that the statutes of HmlLi- ' tion have Intervened. The railroad company holds that tho action should have been taken wilhin three years' time Judge Harris Is holding court at i Morgan today and ho may not return to Ogden until tho end or the week. His division of the district court will be opened in Ogden for the regular Septorabor term September 8. |
