Show AMENDED FRANCHISE This Amended Franchise dated and executed this 13th day of May, 19G8, WITNESSETH WHEREAS, Iron County granted a franchise to Esca-lante Esca-lante Valley Electric Association, Associa-tion, Inc. for a period of forty-nine forty-nine (49) years beginning November 13, 1945; and WHEiiEAS, Escalante Valley Electric Association at the time said franchise was grant, ed only furnisned power to its own members but now furnishes furn-ishes power to both members and non-members; and WHEREAS, th language of the original franchise might possibly be limiting in its reference re-ference to members, and it is deemed advisable at the request re-quest of Escalante Valley Electric Association, Inc. to clarify said language by referring re-ferring to consumers, whether they be members or non-members; and " WHEREAS, all other provisions provi-sions of the ordinance, including includ-ing the original beginning date, restrictions and the term thereof, shall remain the p-ame. NOW THEREFORE, be it or-dained or-dained by the County Commissioners Com-missioners of Iron County, Utah, that the original franchise fran-chise shall be modified to extend ex-tend to the service of consumers con-sumers of the cooperative whether they are members or non-members, and shall provide pro-vide as follows: 1. The Escalante Valley Electric Association, Inc. shall have the right and privilege, and the same is hereby granted, grant-ed, the right to contract, maintain, main-tain, extend, and to operate on and over the roads, highways, high-ways, streets, alleys, and thoroughfares in western Iron County in the vicinity of New Castle, Beryl, Modena, and generally in the Escalante Valley in Iron County, Utah, for the purpose of furnishing electrical energy to inhabitants, inhabi-tants, whether or not members of Escalante Valley Electric Association, Inc., In western Iron County, and for this purpose, pur-pose, may place poles, lines, posts, braces, and such other things as are necessary to the safe and economical construction construc-tion and operation of its transmission trans-mission lines and distribution system, all to be under the supervision of the Roads Committee Com-mittee and Roads Supervisor of Iron County, Utah, and in accordance with the laws and ordinances of said County now in force. 2. The foregoing privilege and franchise shall continue for a period of forty-nine (49) years from the original date. 3. In consideration of the above grant, the Escalante Valley Electric Association, Inc., agrees during the continuation con-tinuation of its franchise to maintain its transmission lines and distribution system in a proper manner and in such a way that there will be a minimum of hazards and interference with travel traffic along said roads, highways, streets, alleys and thoroughfares; thorough-fares; to move said lines to alternate locations at Its own expense should such a move be necessary to permit the County to make improvements to the said roads, highways, thoroughfares, streets and alleys; al-leys; and in addition thereto will pay to the County of Iron One ($1.00) Dollar per year during the life of this franchise. 4. Provided, further, that this ordinance and amended franchise shall be published immediately, according to law, and shall take effect fifteen (15) days from date of passage pas-sage set forth below.
