Everyone seemed to think that this would be a good idea. Following discussion Councilman Rogers was assigned the job of reading and approving the minutes for this meeting at the next council meeting. Councilman Rock commented on the problem of not going out for bids on purchases. He said that bids should be obtained on all major purchases. He indicated that all department heads had been instructed to get bids on all things purchased and that we should be sure to do this. MAYOR SANT discussed a aewer back-u- p problem which occured Saturday morning Feb, 11, at about 10:30 a.m. It seems that Clayton Peterson, received a call about 10:00 a m. that the sewer at about 1285 N. 450 West was bubbling, he went to investigate and found that it was plugged, he got the auger and unplugged the sewer. About 11:30 p.m. Mr. and Mrs. Johnny Owens and Mrs. Bonnie Doman discovered that the sewer had backed up and flooded their basements. The Owens had about inches of sewer water waste in their basement. The Owens notified Clayton Peterson Sunday morning about their problem. The Doman house was not as bad as the Owens, Mayor Sant introduced Mr. and Mrs. Owens and Mrs. Doman and asked them if they had any comments, Larrie Carmichael, attorney for the Owens passed out a Notice of Claim to the Mayor and council. Such notice was read and discussed by the Mayor and council. 3-- MAYOR SANT asked Mrs. Doman if she had any comments for the council, she indicated that she was very pleased with the councils and mayors concern. She indicated that she was hurt less than the Owens. Both families had to move out of their homes for a couple of days. The Health Dept, indicated that houses were not fit to live In until they were cleaned up. Mrs. Owens started to make a statement but was stopped by Mr. Carmichael. Councilman Rock said we should contact our legal council before any action is taken on this matter. THE MAYOR stated that the city attorney would be notified and that future contact with the Owens concerning this matter would be handled through the city attorney. The mayor further stated the information in the claim was incorrect and asked the Owens if they really understood what was written in the Notice of Claim. Their attorney stated a change could be made within 90 days concerning the content of the claim if it was incorrect. The mayor said he was not aware of the sewer problem until Monday, Feb. 13, at about 4:00 p.m. and the issue with Clayton Peterson, he called the insurance agents office, and asked them to take prompt action with this matter. THE MAYOR then tried to get in touch with the Owens and Domans' and was unsuccessful as they apparently were not staying in their homes at that time. Mayor Sant was notified Tuesday afternoon that the insurance adjustor, upon evaluation of the matter, said the city was not responsible for the accident and therefore not liable. The mayor stated even though the city did not directly clog the sewer it was obvious the sewer did backup and in the opinion of our city maintenance superintendent, there was mitigating circumstances involved with the design of one of the sewer main culverts that could have caused an obstruction in the sewer pipe. The mayor and Councilman Kidd made an on site inspection of the Owens and Doman homes with Ron Layton, Health Dept, inspector Tuesday afternoon and were sympathetic with the conditions caused by the sewer backup. THE MAYOR called the insurance adjustor and told him he was not satisfied with the opinion rendered. He asked the insurance company to call another consultant or engineer for his opinion. He also recommended to the insurance company that the contractor who installed the sewer main be contacted and made aware of the situation. The mayor stated he had not contacted the news media but felt it was important the citys position beit understood. was imporHe also thought tant our citizens know that IT IS also important that everyone understand that city officials cannot take monies that are not budgeted or allocated to pay off damages when we have liability insurance that costs us thousands of dollars for this purpose. The mayor said he hopes the insurance company will continue their investigation and that the matter can MEL WOOD indicated that there were two homes in the Eves Garden number four which are in violation of the building codes in that the buildings are too close together. Mayor Sant said to be sure to have the building inspector, Harley Abshire, check with Clayton Peterson on these violations. These homes are located on 175 West. Councilman Rock, again said, it was very important that we provide the notice of claim to the city attorney. The mayor indicated this would be done. Mayor Sant said that we are going to put in for a Title 6 Grant with Clinton city for the purpose of hiring a dog catcher. Harold Giles, of our city, is very interested in obtaining this position. THE MAYOR mentioned that there is also a grest deal of interest about a possible merger between Clinton City and Sunset City. Mayor Sant said there is a program by which we can have someone from the University come and give us a professional opinion on the of question v that multiple dwellings in the city. He asked the council to be sure to review the ordinances before the meeting with the city attorney to amend the ordinances. MEL WOOD, commission planning chairman, brought up an aerial photo of the city, which he had gotten from the county. He said that it was a couple of years old, but we would be furnished another one in the near future. Mel said that Mr. Sillitti had presented his final plan on Commonwelth Square to the Planning Commission. He said they had approved the plans with the exception of the multiple dwellings units which are north of 2575 North and that they will not approve the multiple dwelling units until the moratorium is lifted. Mayor Sant indicated he feels that this is an ideal site for apartments because there is not residential homes in the area. He said that we need signatures on the check list and then we can allow building permits to be issued. Councilman Rogers made a motion that the Sillitti development be allowed as Sub-divisi- Assigned As Tank Commander Sergeant James A. They think that is about all we can do. Clayton was told to get some estimates on doing this. SANT MAYOR said in reference to the reservoirs, that it appears an over all cost could be about $270,000 00. He said strictly unofficially that he is hoping to be able to get about $200,000 from the to help with this county project. He said then we would subtract whatever labor we pul into the project. Mayor Sant said we have got to make sure the Eves complex is made to comply with the storm water run-of- f requirement. He said that this has never been clarified to the ves' and that it is important to do this. He told Clayton Peterson to go and talk to them about this and then make sure that they understand their obligation. He said that the curb and gutter along 2300 North has to be installed, he also indicated that there is an iron grate and the canal which are in need of repair so water can run through it. HE SAID that the only person using the c&nal is Mr. Kay. He said they need to look at the street which is to be installed about 250 West, because if they do it as originally planned, it would put the road too close to Mr. Kays house and maybe we could get the Whites to move to the east their so it would not be so close to Mr. Kay's house. Councilman Kidd said Mr. Kay is willing to give 15 feet to the city to construct this street. He said they had had a very good year with losses held to a minimum. The total dollar value losses was $17,910 00 He would like to compliment the Fire Department for the good job they did last year. Councilman Rock went over the financial report for January and said we were 58 percent into the fiscal year. He said that we are 1.2 percent under our predictions on the water budget for the year. Councilman Rock said he was working on new forms for zero base budgeting and programs. |
