R. Morrison e to stand. A jury in the lower court al-p al-p lowed Morrison "the judgment. The de-f de-f fendant attempted to have the case re-x re-x versed on the ground that the court had r not properly instructed the iury re-U re-U garding the negligence of a fellow ser-1 ser-1 vant. p The opinion was written by District sv Judge F. Eriekson and was concurred gi in by Chief Justice MeCarty and As- B sociate Justice Frick. Morrison was an T engineer fo rthe defendant company, tl August 17, 1904, he was in charge of a cl construction train near Caliente. The pi train waa run into by another train, and ' Morrison was so badly injured that he lost the sight of an eye.
