Morrlssey, attorney for Cowley, filed an application In Third district court for a writ of habeas corpus, alleging the city ' court Judge was without authority for his action. Two riead Oullty Resulting In dismissal of a venire -already summoned preparatory to start of the trial, William Farber and Hilton McMillan, originally charged as Chubby Farber and ' George Peterson, pleaded guilty Monday In Salt Lake City court to a bookmaklng charge. Farber was sentenced to serve three months In the county jafl and pay a fin of 250. McMillan was sentenced to one month in Jail and fined (100. Both Jail terms were suspended,, conditioned oa payment of the fines and a stay of execution was granted, expiring Tuesday at 5 p. m. Bill Browning, C E. Shafer, Cowley and Don Coulter pleaded guilty to a similar charge and . were sentenced. Jail Term Suspended Coulter was sentenced to serve 30- days In Jail and fined 1250. The ' Jail term was suspended on pay ment of the fine. Browning was sentenced to six months In Jail; Cowley and Shafer were each sentenced sen-tenced to four months In JalL Stays of execution on all of the latter group of penalties were granted and notices of appeal filed. The . stays expire December 20. In the case of Browning, Cowley Cow-ley and Shafer the Jail terms are Identical in two complaints, upon one of which the defendants were convcted by a Jury and one to which they pleaded guilty. Against Farber and McMillan the . state dismissed two remaining bookmaklng complaints. In the case of Browning. Cowley and Shafer the state dismissed one -remaining bookmaklng complaint. Dismissals Explained- Lack of evidence was assigned aa reason for the dismissals and the action cleaned pending court calendars before Judge Wllford Moykt Burton of all bookmaklng cases except those against Clifton L. Newton, William Rogers and George Hepner. Three cases are pending against each of the latter named defendants. The trials were continued to December 37. Two other types of gambling cases, one based on Illegal operation opera-tion of a card game and the other based on Illegal operation of a dice game, also are pending. Like the bookmaklng cases, the Utter oases grew out of surprise raids conducted con-ducted November IS. |
