The Jury in the case of James Howard! on trial for the murder of Gov. William Goebel on January 30, 1899, found the defendant guilty and fixed the punishment punish-ment at life-imprisonment , After a disagreement at 10 o'clock the Judge ordered them to return to their room for further deliberation. ' This they did, reporting finally at 11 o'clock. Howard has twice before been convicted con-victed on the charge, the first time a death verdict being returned and the second a life-sentence. Each time the caBe was reversed by the Court of Appeals. Ap-peals. William Goebel, Democrat, was shot from ambush while contesting the election elec-tion for Governor with W. S. Taylor, Republican, who held the certificate of election. Goebel lived two days. In the meantime the Democratic majority of the Legislature declared him elected Governor and he took the oath of office on his deathbed. Conspiracy was al leged and Taylor, Caleb Powers, James Howard, Charles Flnley, Henry Yout-sey Yout-sey and a number of others were indicted in-dicted for complicity in the murder. Youtsey was convicted and Is serving a life-sentence. Powers, like Howard, has been twice convicted and Is awaiting await-ing a third trial. . The feature of Howard's trial was the testimony of Henry Youtsey, who declared de-clared that Howard fired the fatal shot Howard was not visibly affected by the verdict. The Jurors took only one ballot on the question of guilt -or Innocence, ail twelve voting for a verd'.ct of, guilty. The disagreement was a&to the extent of punishment and on this question nine voted for the death penalty and three for a life sentence. On the nxt ballot two of these who vote! for life sentence came over with the nine. Juror Burke then announced that he would under no circumstance vote for the death penalty and a verdict of life sentence was afterward agreed upon. |
