The Supreme court late this afternoon after-noon handed down a decision In the case brought by the Attorney-General against Chief of Police George A. Sheets to test the legality of the confirmation of his appointment to the head of the Police department by a minority of the City Council. Appointment Was Illegal. ' The opinion, which is written by Chief Justice Baskin and concurred In by Justices Bartch and McCarty, holds that Sheets' appointment was illegal, and that he is not entitled to exercise the powers of Chief of Police, and orders or-ders that he be at once ousted from office, of-fice, refrain from performing any .of the duties thereof and pay the costs oi the action. Creates a City Liability. The reasoning by which this conclusion conclu-sion is reached is the view that the appointment ap-pointment of a Chief of Police creates a liability against the city, in which event, it is held, that under the statutes a majority of the Council elected is necessary to confirm an appointment.
