Show CITY AUDITOR PAYS ONE POLICEMAN Warrant Is Issued to Sergt. John Hempel, Petitioner in the Man- damus Suit. Police Sergeant John Hempel yesterday yester-day received a warrant for J83, the amount of his salary for March, from City Auditor Reiser. The warrant was issued by the Auditor on receipt of an alternative summons from Judge Morse that he either issue the warrant or appear in court to show cause why he should not. Sergeant Hempel received the warrant war-rant late in the afternoon and had it cashed immediately. The Auditor says that the summons of the court removed the responsibility from him, but that he will not issue warrants to other unpaid members of. the police department unless similar action to that of Mr. Hempel is taken, or unless the payroll is signed by Capt. Burbidge. . . "I am anxious to see the policemen get their pay," declared Auditor Reiser last night. 1 hope some plan can be devised by which I can feel justified in drawing warrants for each and every officer, al-thcugh al-thcugh I can't Hay yet what 1 will do. not until 1 look Into the matter deeper. City Attorney Xye has informed nie that while the ordinances provide for ibe signature sig-nature of heads of departments to payrolls, pay-rolls, an Auditor Is Ju.-s titled . in isruing warrants when he is certain that the services ser-vices have been performed. I knew John Hempel h:id done his work, and as soon as the writ was served on rne from the District court 1 decided that the responsibility respon-sibility was removed from, my shoulders and that the court's order would serve as proof if th?re are any consequences. Knowing that Hempel hart done bis work 1 could not go into court except upon some point of law. and all points involved will be thoroughly gone over in the Sheets case, which comes up Monday in the Supreme court. I hope to llml some way at once to issue warrants to the other policemen." |
