V f - ' " - ssssiBBsses A The Judgment of the lower court in the damage suit of Anna Munx, administratrix admin-istratrix of the estate of Charles Meyer, deceased, vs. the Standard life and Ac- -ctdent Insurance company. Is reversed. -with costs, in an opinion handed down today in the Supreme court. , - The suit was instituted by the plaintiff plain-tiff In the Third District court to recover re-cover $500, the amount of accident policy pol-icy carried by Charles Meyer at the time of his death, on June 29. 1900, when he was accidentally killed near Kem-tnerer, Kem-tnerer, Wyo. The defendant demurred to the complaint com-plaint on the ground that it did not state facts sufficient to constitute ' a cause of action. The demurrer was sustained sus-tained and the plaintiff, falling to amend her complaint within ten days, as ordered. Judge Morse entered Judgment Judg-ment for the defendant, whereupon the plaintiff took th2 case into the Supreme court on appeal. .The cause Is remanded, with directions direc-tions to the court below to overrule the demurrer and proceed with the trial of the case. The opinion, which Is written by Jus-tire Jus-tire Bartch, Is concurred in by Chief Justice Baskin and Justice McCarty. Fire in Coffin Factory. ROCHESTER. N. Y., April 20.
