Show UNUSUAL REQUEST . r Special Jury Asked to Try a Case Involving High Finance. NEW YORK. Feb. '9.A motion has been made before Judge Bifschoft of the Supreme court, that a special Jury be impaneled to try the suit Instituted b.v the Industrial and General Trust, limited, lim-ited, of London against J. Kennedy Tod and other financiers, in which more than 11.000,000 is involved. This. is the first time that a request for a bpccIhI Jury in a civil case has been made to the Supreme court for many years. The suit was brought eight years ago to recover damages for the alleged unauthorized un-authorized sale of bonds of the Birmingham, Bir-mingham, Sheffield & Tennessee Railroad Rail-road company, owned by the trust. The first trial resulted In a verdict of $355,-100 $355,-100 for the trust. The application for the special Jjry was made in behalf of Banker Tod and his associates on the ground that an ordinary Jury would not be uMe to understand un-derstand the case of prrperly fixing the damages. The decision was reserved. |
