Allen, wealthy i sheep rancher of Draper, was found guilty j today of a charge of grand larceny for j having killed six horses and two mules j in Cedar valley, Utah count y, which he j alleged had been continually trespassing on his property. Counsel for Mr. Allen immediately announced that they will ap- peal the cast; to the Utah supreme court on the grounds that there is a Question ! of law whether or not eorraling animals i to prevent their trespass is grand larceny, j They allege also that this question of law i was decided adversely for the defendant by the jury, whereas, t hey assert, the court alone had jurisdiction to determine i a point in law and should itself have made 1 the decision. During the trial the defense stated that, in November, 1918, Mr. Allen had his employees corral wild horses which had been trespassing on and damaging his property. He uses his lands for the grazing graz-ing of thousands of sheep, and alleged that the wild horses ale much of the 1 grass, damaged drinking troughs and otherwise constituted a serious nuisance to his property. He stated that when he found some of the horses without brands he shot them. Afterwards, so the defense stated, the animals killed were claimed by various persons upon whose complaint Mr. A'llen was arrested. The point of law as to whether the corraling cor-raling of horses or other range animals trespassing upon property constitutes grand larceny, is one which the stockmen of the state will follow with closest interest, in-terest, for similar cases are continually arising on the range. Counsel for the defense contend that shooting animals is not grand larceny under the laws of Utah, and assert that the court should have interpreted the law in favor of the defendant. Mr. Allen is one of the most extensive sheep raisers in Utah. The court yesterday fixed September Sep-tember 22 for the imposition of sentence. Steps looking to an appeal of the case to the supreme court will be taken at once. |
