As amended by congress and approved by the president on May 16, the espionage espion-age act is further reaching than the original act, and while before the amend-ment amend-ment to section 3 was made it was difficult dif-ficult to reach any but enemy aliens, under the new provisions it is designed to bring directly under the law all disloyal dis-loyal remarks or statements, as well as acts of American citizens which may not " be In thorough accord with the govern -ment in its conduct of the war. Under the provisions of the act before amend-v amend-v ment it was difficult to reach American Ameri-can citizens unless some overt act, to hinder the progress of the war, was committed. com-mitted. A copy of the act. as amended, was received yesterday by tho local office of the department of justice, and it provides pro-vides tkat it shall bo unlawful for anyone to matt or convey false reports or un- jtfrue statements with intent to interfere wii h the operation or success of the mfu-y or naval forces of the United jfaTes or to promote the success of the enemies; to say or do anything, except : by way of bona fide and not disloyal advice to an investor, with intent to obstruct ob-struct the sale of United States bonds or other securities of the United States, or the making of loans by or to the United States; to cause or attempt to . cause or incite insubordination, disloyalty, mutiny or refusal of duty in the military or naval forces, or to obstruct or attempt to obstruct the recruiting or enlistment service. It is also unlawful to utter, print, write or publish any disloyal, profane, scurrilous scur-rilous or abusive language about the form of government of the United States, or of the. constitution, military or naval forces, the flag or uniform of the army and navy, with intent to bring the United States into contempt, scorn, contumely or disrepute, dis-repute, and to promote the causes of the enemies. Under the amendment it is unlawful to urge, incite or advocate any curtailment of production in this country of any of the commodities or products necessary or essential to the prosecution of the war, with intent, by such curtailment, to cripple or hinder the United States In the prosecution of the war, or by word or act support or favor the cause of any country with which the ,United States is at war, or by word or act to oppose the cause of the United States in the present pres-ent war. The punishment for violation of the espionage act as amended is a fine of not more than $10,000, or imprisonment for not more than twenty years or both. Concerning the disposition of mail used in violation of any of the espionage acts or its amendments, upon satisfactory evidence evi-dence that any person or concern is using us-ing the mails in violation of the act, the postmaster general may instruct the postmaster at any postoffice at which mail is received, addressed to such person per-son or concern, to return . to the postmaster post-master at the office at which they were originally mailed, all letters or other matter mat-ter so addressed, with the words "Mail t(W his a3dress undeliverable under es-Wnage es-Wnage act," plainly written or stamped lxipon the outside thereof, and such mail , so returned to such postmasters shall by them be returned to the senders thereof under such regulations an the postmaster general may prescribe. |
