Show NOTICE OF TRUSTEES SALE whereas benjamin W driggs and olivia P hia wife as party ol 01 the first part executed and delivered to james H bacon trustee as party of the second part their certain deed of trust bearing date the first day of may A D 1890 to secure the payment of thirty four hundred dollars and interest thereon according to the tenor and effect of a certain principal note and interest coupons thereto attached which are more particularly described in eaid deed of trust said principal note being payable on the first day of may A D 1895 which ca d deed of trust was recorded in the recorders offida of utah county utah in volume no 8 of mortgages etc at pages to inclusive of the records ot said office and civen upon the following described premie ea to wit the south halt of lot two 2 in block twenty 20 plat A pleasant grove city survey area one half and 2160 2 of an acre situate in the county ot utah and territory of utah together with any and all water rights owned by said parties of the first part or either of them or belonging with or nse dupon said premises or any pan thereof and whereat Where aa it is provided in said deed of trust among other things that in case default be made in the payment of said indebtedness or any part thereof with interest thereon as specified in faid principal note and the interest coupon thereto attached or for non payment of taxes or neglect to renew ns urance then and in such case on the application of the legal holder of said note it shall be lawful for said party of the second part after having advertised lucli sale for twenty days in a newspaper published in said county of utah to sell said premises together with all the right aad equity of redemption of the said party of the first part their heirs administrators and assigns alk rein at public auction at the from door of the court house in the said county ot utah and whereas the said party of the first part and each of them have made default in the of the interest on said principal note due on the first days of may and nov 1893 and 1894 and whereas it is provided in eaid deed of trust that in case of such default the whole of said principal sum secured by eaid deed of trust and the interest thereon to the time of sale shall at the option of the holder of eaid indebtedness or the trustee therein named at once become immediately due and pay 4 able and the baid premises may be bold in like manner and to the same effect as though said indebtedness had fulla matured by lapse of time in said obligations mentioned and whereas the legal holder of said indebtedness debt edness has declared tha whole of sad indebtedness to be now absolutely due and payable and requested said trustee to advertise and sell said premises pursuant to the power and authority in him vested in and by said deed of trust now therefore public notice ia hereby given that I 1 james H bacon trustee as aforesaid alore said will TUB DAT or 1895 at ten a m of said day at the north front door of the county court house of said utah coun tv in city in said utah counte utah sell at public auction to the highest and best bidden for cash said premises hereinbefore described together with all the right title benefit and equity of redemption of the baid benjamin W driggs and ulivia P heirs executors adminis orators and assigns therein forever for the of mayine said indebted ness and the interest thereon and the costs attorneys fees and expenses of executing thia trust and will make execute and deliver to the purchaser or eera at said sale good and sum deeds of conveyance in fee for the gold dated this day of february A D 1895 JAMES H bacan trustee as aforesaid J W ennd attorney |
