Show DAMAGES IN LARGE SUM ARE DEMANDED Mining Company Asks Judgment of $272,824.88 Against Ore-buying Concern. Suit for S272.S24.88 damages was filed in the Third district court yesterday by the Mammoth Copper Mining company of Shasta countv, California, against Beer Sondheimer & Co. of New York for alleged al-leged failure of the defendant company to fulfill a contract to purchase ore. In the complaint it Is alleged that the defendant contracted with the plaintiff in Salt Lake on September 29, 1014. to purchase pur-chase all crude ore mined from plaintiff's propertv from September 2U, 1014, to February Feb-ruary 26. 1916, assaying as high as TA per cent' metallic zinc. It is further alleged that the plaintiff mining company mined during the period of the contract and delivered de-livered to the defendant's smelting plant at Barticsvllle, Okla.. 10.074.313 tons of ore in accordance with the contract. The plain tifr alleges tiiat only 1,4 IS, -8S2 tons of the delivered ore were received re-ceived and paid Tor and that the defendant de-fendant refused to receive and pay for the remaining 9.52.t,931 tons, which, it is Eiileserl. was flnallv sold by plaintiff for S23S.27S.76, at h loss of S272.S24.SS to the plaintiff, which amount is prayed as damages. |
