Show OUTLINES RULES OF NEW WEIGHTS LAW State Dairy and Food Commissioner Com-missioner Formulates Set of Regulations. EXPLAINS ENACTMENT Document Intended to Leave' No Excuse for Not Following Fol-lowing Statute. By way of elucidation of the requirements require-ments of the new weigh u and mwjrec law, the state dairy and food commission commis-sion vesterday formulated and adored rules and regulations as to the eaJe and manufacture of food products. The rules are designed to acquaint producers with the requirements of the law bo fully and explicitly as to leave no excuse for noncompliance. non-compliance. The rules and regulations a? adopted follow: Labeling a) Ail food in package form must be sold as to net fflpt, measure or numerical count, unless otherwise specified under the law or regulations based thereon. (b All markings on containers must be on the top or side of package and statement state-ment as to contents Fball be plain and conspicuous and shall not be a j part of or obscured by any legend or design, and shall be so placed and in such characters as to be readily seen and clearly legible when the size of the package and the circumstances under which It is ordinarily examined by purchaser or consumer are taXen into consideration. Food The terrr! "food'' as used in these reflations ".-hall include all articles used for food, drink, confectionery confec-tionery or condiment by man or other animals, whether simple, mixed or compound." , Meaning of ''Package." Package The worvi "package" as used in these regulations ehal! include in-clude package, caxton, caje, can. box. barrel, bottle, phial or other receptacles recep-tacles put up by the manufacturer prior to the order of the commodity by the purchaser and shall include both wholesale and retail package, with the exception of shipping cases. Marking ap to weieht or measure fa) Liquid contents mus; be stated in terms of measure. fb Viscous or semi -solid foods, mixtures or compounds com-pounds may be labeled to indicate either weight or measure, providing the proper quantity la made apparent appar-ent in the labeling, and such statements state-ments in labeilny must, therefore, be definite and shall properly indicate whether the quantity is expressed in terms or weight or measure, (ct For example. "Weight 12 ounces." or "1? ounces avoirdupois,'' or "Volume 12 ounces." or "12 fluid ounces." (d) In connection with the weight, measure or numerical count no qualifying word, phrase or clause shah be used, such as "the minimum." "not less than," "average." "when packed," or a Statement that the contents are "over" a certain amount or a statement state-ment that the contents are "between" certain limits. Exemptions Allowed. Markings as to weight (a) Packages Pack-ages containing two avoirdupois ounces or Ie of food shall be exempt ex-empt from markings in terms of weight. (b. A package containing one fluid ounce or less of food shall be exempt from markings 1n terms of measure. (c When a package Is marked as to numerical count and contains In nulla six or lew. the weight of such units in the aggregate aggre-gate being less than two avoirdupois ounces It shall for the purpose of this regulation be exempt from markings mark-ings in terms of numerical count. d The quantity of all solids must he expressed in terms of weight or count.
