Show EXPERTS DEW AHATHE SUE Man Who Slew Father Leo Hein-richs Hein-richs at Altar Has Little Hope Left. PROSECUTION HA,S NEARLY COMPLETED ITS CASE Scores of Worshipers iu the Church, but Only Altar Boys Witnessed the Tragedy. DENVER, Colo., March 10 The prosecution iu the case of Giuseppe Alia, charged with the murder of Father Fath-er Leo Hoinricha in St. Elizabeth's Catholic church, Februarj- 23, nearly completed the presentation of its evidence evi-dence today and the fate of the defendant defen-dant will probably rest in the hands of tho jury by tomorrow night. The developments todii' showed that there woro only two witnesses to the actual killing and while there were seventy sev-enty or eighty other pTplo in the church at the time., none of them saw tho shot fired. Tho suggestion of a plot was introduced intro-duced by the testimony of Mrs. Van Cleave, but there was no corroboration 1 of her testimony. Alienists Watch Slayer. During tho entire morning session eight, alienists watched Alia very close-I close-I ly. As during tho progress of the trinl yesterday, Alia sat most of tho day with downcast eyes, but occasionally he would look at the jury or a witness and with blinking eycH would seem to be trying to make out what was going on. August L. Mattei. an Italian who has acted as interpreter iu the various interviews with Alia held by Mr. Stidgcr and the several alienists, testified tes-tified along the Hue cf the opening statement of the District Attorney, in regard to the manner in which Alia answered the questions in the first interview, in-terview, lie testified that Alia at ono timo declarod that if the physicians wished to make him out insaue he was willing to act the pari. On cro5s-exaiDjnntion Mattei said Alia told liinr he was excommunicated from the Catholic church because he had been scon coming from a Protestant Protes-tant church. For that reason he could get no work nor a place to live , in Italy. He therefore left for South America. While there he was told by a eountryman of his that his wife had boon untrue to him with a priest. Ho told these stories to Mattei without any show of feeling. The only lime Alia showed any excitement, Mattei said, was when he told of the killing. Export on the Stand. Dr. George A. Molccn. one of the alienists who examined Alia, was the noxt witness. He rend his testimony from uotes he made during the examination. exam-ination. His 6tory confirmed the tes-tiinon3' tes-tiinon3' of Mattoi in regard to Alin's life and his story of the incidents surrounding sur-rounding the shooting. All these details de-tails were clear in Alia's mind with tho exception of tho actual firing of the fatal shot. Dr. George A. JsTewhouse read his tcstimon3- in regard to the examination ho made at another time from that to which Dr. Moleen had testified. His testimony confirmed that of the previous witnesses. At the afternoon session Detective Claude Bossio testified regarding his interviews with the prisoner shortly after his arrest. He told of visiting Alin's room, and finding among his effects a box of cartridges, some clothing, cloth-ing, a file and some other tools. Tho file showod lead in its rough sides, nnd it was intimated that Alia had used it to sharpen tho bullets found in his gun. Alia had claimed that he had bought these bullets . in South America at tho same time that he bought the revolver. Gruesome Exhibits. The revolver, cartridges and filo wero exhibited to the jury. Bossie repeated re-peated tho story of Alia's crime as told him by the prisoner. His testimony testi-mony wns similar to that of other witnesses, wit-nesses, except that Bossie said Alia asked him if the priest he had shot hntl a scar on his forehead, and when informed that Father Leo had no such scar. Alia declared he had killed tho wrong man, but anyway ho was a priest. Mrs. M. F. Van Cleave, a communicant communi-cant of St. Elizabeth's church- testified tes-tified sho saw Alia at the church threo times before the tragedy, and each time he was accompanied by two other men. On the second visit the men talked together, and Alia pointed toward tho altar. She wns 111 tho church at the early mass on February 23, and although she did not. see Ihe actual shooting, she saw Alia running down the aisle waving' his pistol. Boy Witnossod Shooting. Joseph Hincs, aged 5, altar boy at St. Elizabeth's church, was tho 'first witness to tell of the actual shooting shoot-ing Ho t-nid that Father Leo handed the accused man the sacred wafer during dur-ing holy communion, and that Alia spat out the wafer, and, drawing a gun with his left hand, fired at the priest. As Father Leo staggered back Alia rushed down the aisle, waving his gun. Jos Mlillcr, aged P2, the other altar boy, corroborated tho testimony of young Hines. Several other witnesses testified thc3" hoard tho shofv fired and saw Alia running down the aisle. The day's session closed with thn examination of expert witnesses. Four physicians, whoso specialty is brain aud nerve diseases, tontifiod that thoy had examined Alia, and found him whollv sane. The prosecution still has three experts to put, on the stand.
