Albert Keethler, charged with murder In the first degree, for the killing ot his stc p-aon-ln-law, Frank Duvall, on the evening of October 2 of the present year, was called for trial In the criminal division di-vision of the Third District court Monday morning. Owing to tho fact that twelve Jurors are necessary In a case where a capital offense Is charged, some little time was consumed In the selection of the twelve men In whose hands the fate of Keethler will rest. Jury Is Secured. It was not until A o'clock In the after neon that tha Jury was Anally accepted, and, after an opening statement by District Dis-trict Attorney Loofbourow . the taking of teatlmonj was begun After a ground-plan ground-plan of the house, where the killing occurred, oc-curred, was Introduced into evidence, Una Duvall whose husband was the victim of the affair, was called to the stand. Mrs. Duvall 'l Story Mrs. Duvall said that she heard screams On the v. nlng of the killing and ran out Of her room, around the house and .-n-ti red the klti hen, going from there to the bedroom occupied by her mother and sti p-fallicr. When she opened the ihmr of the bedroom, she said, her mother was Iving on the bed. Her hands were- held b her step-father with his right hand .-nd lu his left hand there was a revolver. Victim Enters Room. later. Duvall entered the kitchen and proceeded tit once to tbe bedroom. I'pon entering this room, she said, Duvall at nnore dropped on his knee and seized the left hand of Keethler. in which the revolver re-volver turn held. Keethler then loosened hlfl Wife's hands and a struggle ensued between the two men. In the struggle tWO shots were tired .mil Duvall then ran ut of the room and died a few minutes luter. Cross-Exnmination Not Concluded. The cross-examination of Mrs. Duvall bad not been concluded at the hour of adjournment and will be resumed this morning By agreement of counsel. Judge Armstrong Arm-strong allowed the Jurors to separate and fco to their homes, and this rule will be followed during the trial |
