Show PIgHTOVER MANY MILLIONS Fair Will Case Developed aNew S a-New Sensation Yesterday terday A LATE WILL PRODUCED Brought Into Court Very Securely Framed Under Its Provisions the Vast Estate Es-tate Would Be Divided Equally Between the Three Children and the Distribution Made at Once Attorneys Intimate Very Strongly That the Latest Document i n Forgery San Francisco March 18The legal squabble over the 40000000 left by the late bononza king James G Fair developed a fresh sensation today What purports to be a later will than the one previously offered for probate was introduced into the case The will first produced it Will be remembered was stolen from the county clerks office and in order that the document might be probated Judge Slack had finally ruled that a certified copy of the will might be substituted sub-stituted Upon the alleged will introduced Intro-duced today a bitter contest will hinge This new document purports to be a holographic will I is written In lead pencil on two sheets of legal cap paper I was brought into court uecurely framed between two plates of glass and was presented by Reuben Lloyd attorney for Virginia Fair and Irs Herman Oelrichs of New York daughters daugh-ters of the deceased The attorney for Charley Fair their brother came into court with Mr Lloyd and apparently approved of the proceeding There is no longer any doubt that the three children have combined to fight for the probate of this latest alleged will f Terms of the New VII I Under its provision the vast estate would be divided almost equally between be-tween the two daughters and Charley I Fair and the distribution would be I made at once Under the will previously pre-viously offered for probate these children child-ren would get only the income from the estate during their term of life and upon the aeath of all of them the estate would be divided into three equal parts one part going to the children of Mrs Oelrichs one part to I the children of Virginia Fair unless she die without issue when this share I would revert to the qhildren of Mrs i Oelriclis and the remaining onethird I to the families of several brothers and i i sisters of the deceased Charles Fairs 1 recent marriage causd an estrangement i estrange-ment between himself and his father I and he was cut off with a life interest in the income of the estate His widow would receive nothing In other respects the will first produced pro-duced and the will produced today Tire very similar In the second will how ever Charley Fair receives a special bequest of 500000 to bepaid Immediately I Immedi-ately before the distribution of the S estate Messrs Angus and Crothers and Dr I Mark Livingston are named as executors execu-tors under the second will Angus and Crothers are two of four executors named in the will previously filed and which gave the executors entire control of the estate at fat salaries during the life of l of the three children Forgery Intimated Attorney Lloyd in presenting this second alleged will explained that according ac-cording to its date it was executed three days later than the will previously pre-viously filed He said he would prove that the existence of this will had been known to several people and after along a-long search it had finally been found In the possession of 3 very estimable lady whose name Mr Lloyd would not divulge at present He stated that she had not produced it before because she had read of the other will being offered for probate and she supposed it was a later document than the one held by her Furthermore she had desired to avoid publicity The attorneys for the executors under the first will intimated very strongly that they believed this alleged will to be a forgery Further probate forer Frher proceedings I r were finally continued until April 2 |
