Show NO NEED OF A LEGISLATURE Why the Convention Should AbolLsli the Legislative Assembly To the Editor of The Herald Why should the constItutional convention con-vention provide for any legislature for Utah The convention seems in the opinion of many of its members to be abundantly abund-antly competent and more than willing to enact a complete civil and criminal code for the coming state for al future time Why saddle upon us the useless expense of a state legislature Under the circumstances The principal office of a constitution In former times seems to have been to define and protect individual rights to establish a framework upon which subsequent legislatures could frame I and from time to time amend a code of law to properly apportion and distrIbute dis-tribute the various powers of the tate between the executive judiciary and legislature departments to provide for the election of the different officers to protect the people against hasty or I illconsidered legislation to define citizenship to prevent class legislation and to protect the rights of minorities against the encroachments of temporary tem-porary majorities Under that view of the office of a constitution it should be as brief and simple as possible doing nothing that can be safely left to the legislature and easily amendable by the legislature legisla-ture with the subsequent assent of a majority of the voters of the state and provision should be made that at stated times not too infrequent the opinion of a majority of the voters should be taken upon the calling of anew a-new convention to amend or reframe the constitution But under the view of many mem bers of the convention seemingly that In them is contained the embodiment ofthe wisdom of the ages and can now see beforehand what legislation the people of Utah will want ten years from now better than the people can then see they had better frame a civil and crominal code and prohibit any amendment for the next fifty years except ex-cept by at least ninetenths of the voters provide for no legislature unless un-less it be for the sole purpose of electing elect-ing United States senators and adjourn ad-journ s |
