Show To File For Rehearing FARMINGTON An attorney for a man convicted of a crime (robbery) while another man accused of the same crime was found innocent inno-cent said he will file a rehearing in Second District Court, Farmington. THE MOTION for rehearing then was filed in Second District Dis-trict Court before Judge J. Duffy Duf-fy Palmer. The action came just moments before Judge Palmer sentenced the defendant, defen-dant, Paul Gardunio, of Salt Lake City, to serve five years to life in the Utah State Prison. Gardunio was convicted by a jury after two day s of deliberations deliber-ations of participating in the armed robbery of Hal's Jewelry Jewel-ry Store, Bountiful, last March 7. MEANWHILE, another defendant de-fendant in the same robbery case, Thomas R. Gurule, 29, also of Salt Lake City, was found innocent of the alleged crime. Thus, defense attorney James Barber alleges that there has been an "imperfection "imperfec-tion of justice and jury system" sys-tem" and has asked for a retrial. re-trial. He said the jury found his client guilty based on the evidence evi-dence of just one individual who, he said, admitted participating partici-pating in the part of the robbery rob-bery as a driver of the get-away car. grb |
