Show Oil Activity Is Boost To Road Funds In County Oil activity in the Uintah Basin Ba-sin was responsible for a $1,250.-86 $1,250.-86 boost in Duchesne County's road funds this week. This sum came through the State Department of Finance for payment of 10 per cent of the monies received from the federal fed-eral government under the Federal Fed-eral Mineral Leasing Act, and apportioned under provisions of Section 86-1-49, Utah Code Annotated, An-notated, 1943, as amended by Chapter 129, Laws of Utah, 1945. The federal leasing act provides pro-vides that 37 V2 per cent of the amounts derived from bonuses, bon-uses, royalties,, and rentals received re-ceived from minerals by the United States government from deposits located in the various states shall be returned to the states for the support of public pub-lic schools, or other public educational edu-cational institutions, or for the construction and maintenance of public roads. The law of the State of Utah provides that 90 per cent of such monies shall go into the Uniform School Fund and 10 per cent thereof shall be allocated to the county in which the minerals were produced, pro-duced, to be used by such county coun-ty for road purposes under the direction of the Board of County Coun-ty Commissioners. Pursuant to an opinion of the Attorney General in 1939, all such funds were deposited in the Uniform School Fund. On Feb 21, 1951, and March 8, 1951, the office of Attorney General Gen-eral Clinton D. Vernon gave opinions holding that in accordance accor-dance with existing statutes, 10 per cent of such monies should be allocated to the county in which the minerals are produced to be used by such county for road purposes. At present 22 counties will receive re-ceive additional revenue for road purposes from this source. Duchesne -county will receive $3,904.47 for the fiscal year 1950. |
