CASE After several hours deliberation the jury In the condemnation suit of the city against Mrs. Ellen Stevens and others returned a verdict shortly bo-fore bo-fore midnight last night. According to the decision of the Jurors Mrs. Stevens will receive $19,5".3 for property prop-erty necessary, to the opening of Hudson Hud-son avenue, together with Interest from July 20. The Jury awarded Henry Wessler the first floor tenant of the building, the sum of $S50. while John Stimp-son, Stimp-son, another tenant of the Stevens building, was awarded $350. The decision de-cision of the Jury will be cauveed to Judge Howell when the district couit convenes this morning. With the exception of the amounts awarded to the tenants of the Hudson avenue property, the sum given Mrs. Stevens by the Jury is slightly in excess ex-cess of an even division between the valuations fixed by witnesses for the parties to the suit Wessler and Stimpson will receive little more than half of the estimated value of their leasehold, If the verdict of the jury Is accepted. During the final taking of evidence yesterday afternoon Carl Rasmussen, A. A. Wenger and F. L- Woods, prominent prom-inent real estate men of the city testified testi-fied that they considered the Stevens property worth from $20,000 to $-2,-000. These gentlemen were witnesses for the defendant J. C. Ne and H. H. Goddard. for the city estimated the value of the property at $13,000 and $I6.0nO. It will seem from this that the jury estimated es-timated the value of the property at about an even division between the two highest valuations fixed by tho witnesses on each side. |
