Show NEW CHARGE AGAINST NEGRO Fred Clay, a n-.-gro. this morning pleaded guilty to the charge of exhibiting exhib-iting a deadly weapon, the complaint sl?ting that it was a revolver of .38 caliber. The complaint also alleged r.i at the weapon was flourished In a menacing manner in the restaurant of Clarence Lowe, on lower Twenty-lifth Twenty-lifth street, July 27th. When Clay entered his plea of guilty he aked Judge Murphy to be lenient with him, stating that he had been confined in the city jail for the rast three weeks and felt that ho iuid received sufficient punishment. In passiug sentence, the court stated stat-ed that he considered the case to be an aggravated one and that the defendant de-fendant really deserved greater puu-ijiiment puu-ijiiment than the court could im-i im-i ose Addressing the defendant, the court stated that hereafter when ha has differences to settle with other men, that he not resort to the use of deadly dead-ly weapons "This is a large world.' said the judge, "and there is p1ent of room in K for all people. There Is no ne-ctsslty ne-ctsslty for one man to undertake to f.et rid of another because of petty differences. If at any time yon feel Ogden is not large enough for you end the other fellow, I would advlso ;ou to leave the city aud let the other oth-er man alone. I will sentence you to pay a fine of $99 or serve ninety days !n jail." Clay was previously tried for an cssanlt with a deadly weapon, alleged to have been committed on the person cf Clarence Lowe. The evidence in the case not being sufficient to wai-v.int wai-v.int conviction, he was released. |
