Show FRENCH CITIZEN HELD RjjJ GRAFT WASHINGTON, July 29 Frank J. Godsol, French citizen held on charges of tho French government that no profited several millions of dollars dol-lars on motor truck contracts, was released today by Justice Gould of the district supreme court on a writ of habeas corpus. The French government govern-ment noted an appeal and Godsol was released on $50,000 bonds which he furnished In Liberty bonds. Godsol is forty-glvo years old, a man of wealth and served as a private pri-vate in tho French army, later coming to this country as an attache of one of the French war missions to negotiate nego-tiate motor truck contracts. He was arrested March 8 on a warrant sworn out by tho French ombaBsy. The court gave- three reasons for discharging Godsol. The first was that the complaint was defective In that tho record showed that Godsol obtained the commissions from the Plerce-Arrow Motor company and not from tho French government. The second was that there was in the court's opinion not only a variance between be-tween Ihe allegations nnd tho proofs, but that the "proofs squarely contradicted contra-dicted the allegations." Tho third was that if there were any false representations represen-tations they were In Franco and that under the American law the crime of obtaining money under false protense is committed where the money Is obtained ob-tained and not whoro the pretense is made. Inasmuch as tho acts charged against Godsol would not have constituted con-stituted obtaining money under false pretenses In tho United States, the court held Godsol could not be held for extradition. The court likened Godsol's case to that of a man who learns that another Is about to buy an automobile and goes to u manufacturer manufactur-er and arranges to collect a commission commis-sion provided his prospect does buy. The relation between the motor company com-pany and the French government, the court held were not a trust or fiduciary fidu-ciary In their nature, but simply those of buyer and seller. |
