Show PEIIT1 DEHED BY JUICE PRATT District Judge Arthur E. Pratt has denied a petition by S. C. Stephens, Jr., presented by Attorneys J. G. Willis Wil-lis and D. R. Roberts, to transfer the trial of his suit against Mrs. Luella Doxey to District Judge Alfred W. Agee. Mrs. Doxey was represented by Attorney Georgo Halverson. Mrs. Doxey entered into a contract with W. J. Stephens for building an apartment house, agreeing to pay him $15,000, giving two notes and a mortgage, mort-gage, for $5,000 and $8,000, respectively. respective-ly. She claims it was agreed interest shouldn't begin on the note until 90 days after completion of the building. Mrs. Doxey claims the note and mortgage, as read by her, had the name of W. J. Stephens in them, but that afterward she discovered the name of Mrs. Effio Campbell, Mrs Stephens' daughter, had been inserted. The defendant also claims tho house as built was entirely unsatisfactory. Mrs. Campbell, according to the pleadings, sold the note to S. C Stephens, Steph-ens, Jr., the plaintiff, who is her cous-in cous-in and a nephew of W. J. Stephens. Attorney Halverson pleaded there was a scheme to defraud Mrs. Doxey The litigation started before former Judge J. A. Howell. The plaintiffs had the suit dismissed, said Mr. Halverson, Hal-verson, in order to have it tried by Judge Nathan J. Harris. In this court the suit happened to fall to Judge Pratt by lot. The plaintiff filed an affidavit af-fidavit alleging prejudice. Attorney Halverson offered to agree to tho transfer if plaintiff would pay the costs, but this was not agreed to and Judge Pratt overruled tho petition. |
