Show MORGAN WINS AGAIN IN CONTRACT CASE Salt Lake, Jan. 13. A new trial was granted by tho supreme court, In a decision handed down yesterday, in the suit of James Morgan of Eureka against Child, Cole & Cp., brokers, charging breach of contract on the purchase of $15,000 worth of stock In the Sioux Consolidated Mining company com-pany This Is the second time the suit has been "before the supreme court. In tho first instance the district court of Juab county declared it nonnuit The plaintiff plain-tiff appealed to the supreme court, which decided that it was a proper suit. Next tlmo the district court jury decided that the plaintiff "had no cause of action." Again Morgan took appeal to the supreme court The decision de-cision handed down yesterday reserves this judgment and sends the case back to the district court of Juab county with directions to grant a new trial, the appellant ot recover costs of tho appeal. The decision was transmitted by Justice J. E. Frick and concurred in by Justices D. N. Straup and William McCarty. In the suit Mr. Morgan claimed that the brokerage concern, through Its then agency in Eureka, signed an agreement to buy the stock and split the profits with him in return for information in-formation he furnished the company. Ho charged that the company repudiated repudi-ated the agreement. |
