Show 1TI0!0F JUDGE MADSIL Washington, Sept. 7. Officials of tho department of justice said this evening that the resignation of Uni-ted Uni-ted States District Justice Judge John A. Marshall, district of Utah was entirely volunta-y and wholly unexpected. un-expected. No thought has been given In tho matter of the selection of his successor. The present attorney general, in making recommendations to tho president pres-ident for federal Judicial appointments, appoint-ments, has made personal inquiry into the fitness of candidates and has personally, per-sonally, taken into consideration the local situation and conditions before making a choice. Recently, In making an appointment In Illinois, the attorney general went to Chicago and satisfied himself by personal inquiry and observation before be-fore recommending a candidate. While he may not go to Utah to determine upon a successor for Judgo Marshall, it Is certain he will obtain correct information as to all of the conditions existing politically and otherwise ln the district of Utah beforo he decides upon whom to recommend for appointment. ap-pointment. The age of candidates also will be taken Into account and if the rule heretofore followed by the present attorney at-torney general It observed, no candidate candi-date over GO years of age will be considered. con-sidered. While party organization indorsements in-dorsements will have weight with tho attorney general, it Is believed the substantial indorsement of a majority of the members of the Utah bar would bo moro effective. The attorney general will not move hastily in tho matter, but will take ample time in selecting a man to fill the most important position in the state. Tho United States senators in Utah will not bo consulted as to the choice of a successor to Judge Marshall, Mar-shall, but, following the usual custom, they will be questioned as to the fitness fit-ness of tho appointee before announcement an-nouncement is made of his appointment. appoint-ment. nn |
