LEGAL NOTICES AN ORDINANCE Granting to the Denver and R!o Grande Railroad Company, Its Successors Suc-cessors and Assigns, a Franchise and Right of Way to Construct and Operate a Spur Railroad Track Across Lincoln Avenue Between Twentieth and Twenty.flrst Streets In Ogdcn City, Utah. Be It Ordained by the Board of Commissioners of Ogden City, Utah: Section 1. A franchise and right of way is hereby given and granted to The Denver and Rio Grande Railroad Rail-road company, Its successors and assigns, as-signs, to lay, construct and operate a standard gauge railroad track across Lincoln avenue between Twentieth Twen-tieth and Twenty-first Streets In Ogden Og-den City, Utah, on a rdute the center line of which Is described as follows: Beginning at the west line of said Avenue about 275 feet north from the north line of Twenty-first Street; thence extending northeasterly on a 24 degree curve to the left, and intersecting in-tersecting the east line of said Avenue Ave-nue at a point about 315 feet north from the north line of Twenty-first Street. Section 2. During the terms of this franchise the grantee shall be subject to the following conditions: (a) Said track shall be laid upon and conform to the established grade of said street, and if said grade is afterwards af-terwards changed by ordinance of the board of commissioners, the gran tee shall, at Its own expense, change the elevation of tho track so as to conform to the same. (b) Whenever the said street where such track is constructed shall be paved, then said grantee, Its successors suc-cessors and assigns, shall pave between be-tween the rails and for a space of two feet outside of each rail, with the same material as that used In tho street pavement, and all ties shall be laid upon a concrete base of such thickness as shall be directed by the city engineer. (c) Said grantee shall put in and maintain such crossings over said track as shall from time to time be required by the board of commissioners. commission-ers. (d) The said track shall -be laid and the road operated so as to cause no unnecessary impediment to the common and ordinary use of said street upon which it is laid. (e) Good and sufficient conduits to convey water shall be laid and maintained In good condition at the expense of said grantee, in all the water ditches crossed by said spur track, so as to admit of free-passago of water. (f) Ogden City reserves the right to regulate and control the speed or all trains, engines and cars operuled by tho grantee, Its successors or assigns, as-signs, within the city. Section 3. Nothing in this grant shall be construed so as to prevent Ogden City or Its authorized agents, contractors, person or corporation to whom a franchise may have been or may hereafter be granted, from paving, pav-ing, sewering, laying gas or water mains or pipes, altering, repairing, or in any manner improving said street, but all such work and improvements im-provements shall be mado with as little Injury as practicable to said spur track and the operation and use thereof. Section 4. The said grantee herein, here-in, its successors and assigns, shall, and by the acceptance of the privileges priv-ileges and franchises heroin granted, and In consideration of the same, does bind itself.
