masters of their profession but also as leaders in more than one movement for good government in this city william R hearst has begun his fight in the courts for the mayoralty which he believes he won in tuesdays election and his first step has created a situation apparently without precedent last night he obtained an order from justice gay nor ot the supreme court directing the police to turn over all ballot boxes to the board of elections at once the police obeyed the order as far as they could but when they proceeded after the midnight hours to the election boards office there was no one there to take custody of the boxes and the policemen were compelled to remain in the street tor hours guarding the repositories depositories deposit ories of the peoples votes bater john K voorhis president of the board declined to accept responsibility in the matter pending advice from the corporation counsel air voorhis Is a democrat and when his decision was made known the hearst men turned to charles W page a republican member of the board but he also declined to act and then tho police w ere left in the strange position of trying to carry out the courts orders but were to do so the street in the vicinity ot the election board offices presented A strange sight as hundreds of policemen stood on guard around the patrol wagons and other vehicles in which the boxes been conveyed from the various precinct station bouses colonel alexander S bacon one of mr hearses He arsts lawyers who played a prominent part in the doings of the day made arrangements tor the police to get breakfast in a nearby restaurant tau rant before refusing to receive the official ballot boxes mr voorhis consulted police commissioner mcadoo and the boxes were kept in the police wagons in front of the office of the board of elections pending a decision by the corporation counsel air voorhis aid that the new york state supreme court had held in a recent decision that tho board of elections is not the custodian of tho boxes but that the police are among the attorneys aiding hearst is william M ivans the republican candidate tor mayor in tuesdays election sir ivins volunteered his services to mr hearst and the offer was accepted another attorney acting tor II earst is judge john F dilion who was at one time judge of the supreme court of low a new york nov a sensational developments followed rapidly this morning in the fight of william R hearst to contest the mayoralty election of george B mcclellan having secured last night an order from justice gaynor in brooklyn directing the police department to deliver the ballot boxes to tho board of elections forthwith hearst men lost no time in dispatching patching des fifty automobiles carrying men armed with the courts order to the various police stations where they demanded the ballot boxes in most instances the officers in charge at police stations directed that the boxes be placed in patrol wagons and each lot guarded by five policemen hurried to the office of the board of elections at usg greenwich meantime other hearst men had gone to the homo of john R voorhis president of the board of elections at 11 west forty second street and arousing him asked him to immediately go to his office president voorhis was surprised at the peremptory demand and was quickly informed ot the courts order later he appeared at a window and addressing he hearst men who fairly surrounded the house said that he would not go to the office of the bureau of elections af such an unreasonable hour but that he would appear at ins office and open the same at 9 the usual hour itogay at 3 this morning wagons and automobiles with ballot boxes police officers and hearst watchers began to arrive at the office of the board of elections and an hour later greenwich street in that vicinity was fairly impassable unable to get rid of their charges there was nothing tor the police to do but to await the opening of the office and as every one of the twelve boxes were guarded by alvo policemen a most impressive array of officers was soon in evidence As the morning advanced the balance of the elent thousand boxes continued to arrive and hearst watchers as numerous as the police helped to swell the crowd which waa further added to as the report spread that some startling political move had been made necessitating a great body of officers at the office of the board of elections when hey failed to secure the presence of president voorhis hearst men called upon A C alien chief clerk of the baird at his home on eightieth street mr alien could do nothing for thorn and expressed he thai the court had ed from a misunderstanding he said that a literal compliance with the order would be impossible as the ballot boxes used in greater new york could not by any means be gotten into the room occupied by the board his understanding of the law he said was that the boxes should remain in the possession of the polica for six months following an election he could give no advice as to the immediate disposition of the fast accumulating mu lating boxes and thought that there was nothing to do but to await the opening ot the boards office and let president voorhis decide what to do with the ballot boxes it was said this morning that the sudden move made by mr hearst baat night followed a report received by him that a printing company had been at work tuesday night printing ballots the report was further joithe effect that the ballot boses were to be opened while in the hands of the police and stuffed mr hearst decided to act at once the order secured from judge gaynor directed the police commissioner and all his subordinates in the five boroughs to turn over to the board of elections forthwith all ballot boxes containing ballots and stubs of ballots and also to file with the county clerk before jooa today all envelopes containing tally sheets inspectors returns defectives defect ivec ballots and ballots marked tor identification fi the order was issued pa the affidavit of mr hearst himself the affidavit states mr heartis He belief received a plurality of the votes but that according to the returns more votes than he received were counted for mr mcclellan captain cruse read the order to commissioner mcadoo over the tele paona the commissioners reply was an order to the captain directing him to read the
