Show fira OR s A i LINE OF ACTION IN EDEN WATER FIGHT SA attorney mcmillan MM illan for north ogden people asks that injunction granted sunday be annulled from mondays standard the line of action of the attorney for the north ogden irrigation corn pany in the water litigation was decided upon yesterday afternoon after an all morning session between the attorneys and their clients are now pending two actions one in which the north ogden irrigation company sues george A fuller et al and the second in which francis dark thomas clark and john carver sue the north ogden irrigation company et al in connection with both suits temporary injunctions have been granted in the first order restraining george A fuller et al from interfering with tho flow of thi water in the north fork of the ogden river was issued by judge howell august 1 in the second an injunction was granted restraining the north ogden irrigation company from changing te bed of the north fork of the river after the conference the attorneys tor the north ogden irrigation company mada two moves in the basea now pending attorney macmullan of counsel for the north ogden irrigation company went to salt lake yesterday noon and filed complaint before judge armstrong in the third district court in an action to show cause why william chambers and edwin hill an fn the case of the north ogden irrigation company vs george A fuller efe al should not be adjudged in contempt of court it being alleged in the complaint that the persons named bad violated the injunction granted by judge howell in the second district court august I 1 judge armstrongg Armstron ng ordered a citation issued for the arrest of francala clark thomas dark and john carver and the sheriff was ordered to bring the men before the second district court august 25 and in the meantime to hold them in the sum of tor their appearance on that date the complaint in the contempt pro was made on the affidavit of nathaniel montgomery and J A taylor after securing the citation mr macmillan made a motion in the same court to dissolve the injunction granted sunday in the case of francis clark thomas dark and john carvor vs the north ogden irrigation company and asked the court to change the time for tho hearing from i september 5 to august the date on which the second district court convenes after the summer recess the change in the date for the hear i ing was ordered and the motion taken under advisement the grounds on which the motion to dissolve the injunction were passed were first that the complaint on which the injunction was granted did not show facts sufficient to constitute a cause for action second that the facts stated in the complaint were untrue third that the injunction wag and was improperly and issued and no under faking required fourth that the plaintiffs had ample relief at law and equity or reason tor injunctive lve relief was shown fifth that there was a misjoinder of party to plain tiff the main point that the attorneys made was in securing the Imme Slate hearing of the case for it it be de until tall there are liable to arise further difficulties that will only complicate matters |
