Show oo GOVERNOR NOW ASKED TO PROBE LOY CASE i Salt Lake, Aug. 12 Governor Spry today received a telegram from Li Yung Yeu, Chinese consul at San Francisco, requesting him to take action ac-tion with Attornoy General A. R. Barnes and County Attorney I. E. Wllley with reference to prosecuting Police Patrolman George Cleveland, who shot and killed Louis Loy In a raid on Loy's opium den several weeks ago. Sluco Cleveland was vindicated vin-dicated by tho Jury at the inquest continuous attempts have been made to secure a complaint against him County Attorney I. E Wllley refused refus-ed to issue a complaint against Cleveland, Cleve-land, owing to the fact that the evidence evi-dence showed that Cleveland shot Loy while the man wns attempting to escape!. es-cape!. Mr Willoy informed the legal counsel for the Chinese that if they desired a complaint from his offico they would have to mandamus him through tho courts. v However, the Chinese aro now en-deaorIng en-deaorIng to bring about the prosecution prosecu-tion thiough other means, and Governor Gov-ernor Spry conferred with Mr. Wllley Wll-ley and Attorney General Barnes this morning. It was agreed that the two attorneys should take up tho matter together, and then report to the governor gov-ernor as to what they deemed the wisest course to pursue. In discussing the question Governor Spry said that he did not desire to prosecute Cleveland, and he thought that Cleveland would be glad to face a preliminary hearing and te exonerated exoner-ated of the offense of which the Chinese Chi-nese accuse him. The governor thinks this would finally settle the whole matter. |
