The complaint sets forth; that In March, tho board' of county commissioners' commis-sioners' consolidated the county schodls Into one district and created a board of education; that tho Cache county school district is a fictitious and pretended organization and that tho otlices of tho organization are also false and pretended. The complaint com-plaint also sets forth that the olllcers comprising the county board of education educa-tion are exercising corporate powers without any warrant, charter, grant, or franchise being conferred upon them by law. The plaintiff demands judgment against defendants, that they be excluded from their pretended oillces and that they bo adjudged to bo an association of persons, wrongfully wrongful-ly exercising corporate powers without with-out any authority granted by law.
