Show WHAT'S A CONSTITUTION FOR? The peak of radicalism or one of the highest peaks is to be found in the following plank of the Progressive Platform: "We favor submitting to the people a constitutional amendment providing that congress may, by enacting a statute, make it effective over a judicial vote." In other words congress may, by mere statutory enactment, make an unconstitutional measure constitution. This is deliberate subversion of the constitution to the whim of congress nothing else. It is a definite scheme to encourage congress to act in defiance of the constitution; and, if there is an impartial judicial decision that the constitution has been violated, to set aside the authority of the courts and of the constitution itself by mere repetition of the congressional fiat. Is the constitution worth having, or preserving, or obeying? The so-called Progressive platform thinks not. The American people have heretofore thought otherwise. Because they have thought otherwise for a century and a half, we have a constitution and constitutional freedom. |
