New Fraud Law Giving Crime Fighters a Boost Armed with the new Communications Fraud Act, law enforcement officials and prosecutors on the state level can make Utah the most hostile place to con artists in the world, U.S. Attorney Richard The Communications Fraud Act, passed by the Legislature last year, allows state and local officials to prosecute a wide range of fraud cases, Mr. Lambert told about 150 state, federal and local attorneys, investigators and law enforcement officers. The Communications Fraud Act is seminar the subject of a two-da- y OfU.S. the by Attorneys sponsored fice, the Utah Attorney Generals Office and the Law Enforcement Coordinating Committee. The seminar, which continues Friday, is intended to acquaint law enforcement officials with the act and how to use it. Utalj Attorney General David L. Wilkinson, seminar keynote speaker, said the act will help state officials combat Utah's reputation for hosting a high rate of investment fraud. We need to hone our skills so that we can make some inroads on this image problem that is more than an image problem in this state, he said. Before the Communications Fraud Act was passed, the state had to rely on its theft by deception statute. Under that law prosecutors had to prove intent, making it difficult to prosecute business-relate- d scams. It would have been difficult for the state to prosecute Grant C. Affleck or Jerome C. Gatto under that law so they turned those cases over to federal prosecutors, Mr. Wilkinson said. But now, with passage of the Communications Fraud Act, the state has a statute that is similar to federal wire and mail fraud statutes, said Mr. Lambert, who helped draft the act. The federal wire and mail fraud statutes prohibit a person from devising a plan to defraud or obtaining money or property through fraud or false pretenses. The federal statutes, like Utahs new law, do not require proof that the victims were actually damaged nor do they require proof that the victim relied upon the misrepresentations, Mr. Lambert said. Pharmacists Daughter Gets Probation in Drug Charges A federal judge Thursday sentenced the daughter of a former Kearns pharmacy owner to four years probation on her guilty plea to charges of distributing Percodan. U.S. District Judge David K. Winder sentenced Julie Morrison to three years in prison with a special parole term of three years, but he suspended the sentence. He also ordered her to get counseling. Julie Morrison is the last person to be sentenced in connection with illegal drug distribution from the Kearns Pharmacy, which was owned by her father, Paul Morrison. In addition to Julie Morrison, three of Paul Morrisons other children and a former store employee were charged last June in separate indictments with counts. Inwith Narcotics Metro the vestigators Strike Force said Morrisons pharma drug-relate- d cy was the largest single source of diverted pharmaceutical drugs in state history. DESIGNER Julie Morrison was originally charged with four counts, but in a plea arrangement with prosecutors three of the counts were dropped. Last month, Judge Winder sentenced Paul Morrison to three years in prison on his guilty plea to charges he illegally acquired and distributed 96,000 Percodan pills. Mike Morrison was sentenced in November to five years probation on condition he complete an program. Morrison's two other children, Mark and Margadiret, have been placed on pre-triversion, a court supervised probation. Former pharmacy employee Jimmy N.
