Third District Judge Dean E. Conder Tuesday gave lawyers for the club and Megan Marie Peters until Jan 29 to submit affidavits on the sale of beer at the club. He plans to review the documents before deciding whether to dismiss a lawsuit filed by Ms. Peters, 21, that seeks to open the Alta Club's membership to women or to rule that the club violates Utahs civil rights law. Glenn C. Hanni, the club's lawyer, sought a summary judgment for dismissal of Ms. Peter's suit Tuesday. Her lawyer, Brian Barnard, submitted a motion for a partial summary judgment declaring that the state civil rights law applied to the club and ordering it to no longer discriminate against women. Ms. Peters filed the suit in November after she was denied an application for membership in the Alta Club because it is a club for men, court documents said. The suit is the first of its kind against the club since it was founded in the early 1880s. Mr. Barnard contended that because the club sells liquor and beer, it is an enterprise regulated by the state and a business. il The civil rights law requires places of business that sell beer to customers" to comply with it, documents said. In his written motion, Mr. Barnard called for the court to end the clubs demeaning, unlawful and illegal discrimination against women. That may include, the document alleged, the club's policy directing women and members accompanied by women to leave the club by a side door instead of the main entrance. Mr. Hanni contended in a written brief that the club no longer is regulated by the state because it doesnt house a state liquor store, which is defined in the 1985 Alcoholic Beverages Control Act That law replaced an earlier act, and the Legislature failed to amend the civil rights law to make it current with the 1985 measure, he argued Moreover, the club is a private association protected by the U.S. Constitution's First Amendment and doesn't have to comply with the civil rights act merely because it sells beer to members and guests. He described the club as an exclusive association of members who are prominent in business and public af- fairs. Entry into the club is determined by a vote of its board of directors. Applicants may not join the club if two board members vote against him. Since Ms. Peters filed the lawsuit, the Utah State Bar has adopted a policy that prohibits it from holding monthly meetings at the Alta Club. We have had great activities in the past and need help with the present ongoing projects for the new season volunteers are vital for its success, Mr. Robinson says. Basketball coaches, referees and league organizers are needed for games on Saturdays and one other night per week. Snowshoe making is a popular seasonal project each year. Volunteers who can help in this project may make a pair for themselves. Materials will be furnished. Volunteers are needed to help with the photography club. The club has a dark room and several cameras. Many youths want to learn but need instruction and guidance to get going. Woodworking, leather work and other arts and crafts are of interest to many of the youngsters. Volunteers are needed who have such expertise, or who can bring in ideas and introduce new projects. well-equipp- participating at the Boys Club and an average daily attendance of over 125, all kinds of volunteers can be used.
