Show ORDINANCE NO. 76 " N ORDINANCE PROVIDING (tOR THE LICENSING AND REGULATION OF AMUSE-:MENT AMUSE-:MENT DEVICES. THE BOARD OF COUNTY COMMISSIONERS COM-MISSIONERS OF THE COUNTY COUN-TY OF BEAVER, STATE OF UTAH, ORDAIN AS FOLLOWS: Section 1. -It shall be unlawful for any person, firm or corporation to operate, use, maintain or permit to be. operated or used or maintained, main-tained, on or 'in any property or premises in his possession or under his control, and within the County of Beaver,, State of Utah, outside cne corpora-e Limits or any incorporated incor-porated city or town therein, any amusement device, or to have any amusement device in his possession or under his control with intent that the same shall be operated or Uffed without having first obtained a license therefor, which license shall be as 'follows: $150.00 per annum for the first amusement device so licensed to such person, firm or corporation, and $50.00 per annum for each additional amusement device so licensed to such person, firm or corporation. Section 2. Application for license, to operate, use and maintain an amusement device or devices shall be made by filing a written application applica-tion with the County Clerk of the County of Beaver, and paying in advance a yearly license as herein above set forth. That all licenses so issued shall expire as of the 31st day of December of each year, and shall be renewable as of that date. That all applications for license, as herein provided, shall be approved ap-proved by the Board of County Commissioners, prior to the issuance issu-ance thereof and that said Board may reject any and all applica-rons, applica-rons, if 'in its opinion it is (for the best interests of the County of Beaver that the same be rejected. Section S. Within the scope and meaning of this Ordinance, an amusement device is any machine, device or contrivance not otherwise prohibited by the laws of the State of Utah or Ordinances of the County Coun-ty of Beaver designed to be operated oper-ated or used for amusement or the nlaying of a game upon or in response re-sponse to the payment of some charge or insertion therein of a coin, slug or check. Section 4. Any person, (firm or corporation found guilty of violating violat-ing any of the provisions of this ordinance shall be deemed guilty if a misdemeanor and liable to a fine not exceeding the sum of Two Hundred Dollars or to imprisonment imprison-ment in the County Jail not to exceed ex-ceed three months, or to both such fine and imprisonment. Section 6. This ordinance shall take elf feet (fifteen days after its passage. PASSED by the Board of County Commissioners of the County of Beaver, State of Utah, this 10th day of March. 1947.
