Show Gibson Motion for Mevi Trial Denied by District Court A motion for new trial in the case of convicted killer Charles Lee Gibson was denied and overruled in Seventh Judicial District Court Tuesday by Judge Edward Sheya. Counsel Harry Snow argued for a new trial based on the allegation that the court had erred'in allowing testimony of Gibson's alleged rape of the girl friend of the slain man, Leslie Wayne Wigard, immediately after the fatal stab wounds. Arguina for the state against Snow's motion was County Attorney Bill Benge. Mr. Snow said Wednesday that he will turn to his last resort in the Gibson case, which is appealing to the Utah Supreme Court. This appeal, he indicated, must be made within the next 30 days, and this time will be spent preparing an appeal for submission to the Supreme Court some time early in December. In other District Court actions, Tom Howard Balsley appeared for arraignment arraign-ment on a charge of distribution of a controlled substance. He entered a plea of innocent, and trial was set for March 23, 1977, the earliest available date. In State vs. Jody B. Hartzell on a charge of distribution of a controlled substance without value, Judge Sheya placed the defendant on 3 years probation since she 'had never oerore oeen convicted of public offense, since she has a young child to support, and since she is without any income. In State vs. Michael Dull, the defendant entered a plea of guilty to distribution of a controlled substance for value. Judge Sheya fined Dull $1,000 and imposed a suspended sentence of 5 years in prison, on condition of his good behavior. In State vs. Rodney Quinn, who was charged with distribution of a controlled substance without value, the court ordered a 90-day evaluation at the Utah State Prison by the Board of Corrections. In State vs. Walter Mark Gramlich the defendant entered a plea of guilty to the charge of distribution of a controlled substance without value. Judge Sheya sentenced him to pay a $500 fine and placed him on probation for 3 years. In other matters, the court granted letters of guardianship of David Best, also known as David Trease, a minor; determined the heirs of Clem E. Stover, deceased; appointed an administrator in the estate of Martin E. Davis; granted letters of administration in the estate of Lonnie Joe Titus; granted and approved the first and final accounting and ordered distribution in the estate of Edna Belle Lile; and granted a decree showing due and legal notice to creditors in the estate of Edmund J. Knops. In addition, the following divorces were granted by Judge Sheya: Larry Bray from Maria P. Bray; Carol J. Shepherd from Terrence W. Shepherd; Larry Robert Hixon from Kathleen Hixon; Betty Jane Jeffries from Jessie James Jeffries; Eva Lillibridge from John Lillibridge; and lone Quinn from David Allen Quinn. The court also set three divorce cases for trial. |
