Show Gr&d Bhsriff facing Grand County Sheriff W. H. "Hec" Bowman was on Jan. 24 served with er. The docament, s.'gned by District Judge Boyd Bunnell, states, "Upon reading and filing of the Affidavit of William L. Eenge, Grand County Attorney, and good cause appearing therefore, you are hereby ordered to appear before the above-entitled Court in the Courtroom of the Grand County Courthouse, Moab, Grand County, State of Utah, on the 7th day of February, A.D'. 1973, at the hour of 10:00 a.m.,' then are there to show cause, if any you have, why you should not be adjudged guilty of Contempt of Court and be punished accordingly for wilfully disobeying its Order theretofore made on the 13th day of December, A.D. 1977, The affidavit filed by County Attorney Benge in the matter of the contempt of Sheriff Bowman had been assigned Miscellaneous No.. 303, Order to Show Cause, in District Court. It states, ' 'That on the 13th day of December, A.D. 1977, Dirk Donald Wichterman, Defendant in Grand County Criminal Nos. 564 and 565, appeared before the Honorable Boyd Bunnell, Judge of the District Court in and for Grand County, State of Utah, for sentencing senten-cing on the crimes of possession of stolen property and burglary." The affidavit continues, "That by Order of the Court on said day the Defendant, Dirk Donald Wichterman, Wich-terman, was incarcerated in the Grand County jail for a term of one (1) year, six (6) months of said term being suspended. The Sheriff of Grand County, W. H. Bowman, was instructed to give the said Defendant, Dirk Donald Wichterman Wichter-man credit for the time he had already served, to-wit: approximately approximat-ely 2 months. This Order of the Court wasi incorporated into a written judgement and Order of Probation dated the 3rd day of January, A.D. 1978." It further states, "That at the present time the said Defendant, Dirk Donald Wichterman, is not in the custody of the Grand County Sheriff, W. H. Bowman, although more than three (3) months remains on the time Ordered him to serve by the District Judge." In his affidavit the County Attorney swears he "has investigated investi-gated this matter and there is no evidence that the above-mentioned Defendant has escaped from official custody" and he "specifically alleges that the above-named Defendant, Dirk Donald Wichterman, Wichter-man, was released from custody by the Sheriff of Grand County, W. H. Bowman, or by someone in his control, on or about the 31st day of December, A.D. 1977." The papers were served on Sheriff Bowman by Deputy Sheriff Carl Davis. Contempt of Court carries with it a possible sentence ranging from a fine of up to $200 or a jail sentence of up to 30 days, or both. |
