Show SURETIES WIN CASE IN HIGHEST COURT The Supreme court today affirmed the decision of the lower court in the case of F. P. Smith, doing business as F. P. Smith Wire and Iron Works appellant; ap-pellant; against J. H. Bowman and Fred Hodder, as Bowman & H odder, and H. G. Wilson and F. E. McGurrin as sureties. sure-ties. The action was brought to recover on material furnished the plaintiff, in the construction of a building at the State Agricultural college at Logan. Wilson and McGurrin demurrc-.i to the judgment being entered against them as sureties, contending that the bond was given the college and that the plaintiff had not the right of a lien, an1 therefore did not come in the casw which entitled him to a judgment. The lower court sustained the demurrer and entered iudgment against Bowman & Hodder. ' |
