Show HOWARD TELLS STRONG STORY Defendant in Murder Trial Impresses Hearers When He Gives Description of the Shooting Affray. The preliminary examination of Ernest Er-nest Howard, charged with murder in the first degree, came to a close in Judge Diehl's court this morning. The case was submitted to the court without with-out argument. Judge Diehl will render his opinion Thursday. After the close of the case yes'erdav morning, as reported in THE TELEGRAM TELE-GRAM of 3'esterday, the State put ou one witness in the afternoon. A number of witnesses, including the defendant, were then called bv Judge A. J. Weber. Howard told the story of his life and of the trouble which led up to the killing of Frank Yoursk at Bingham on November 14, li06. The defendant testified that th deceased de-ceased had made a number of threat during the afternoon and evening of November 14 to kill him. He told in a graphic manner the circumstances lead ing up to the killing of Yoursk. At all time the defendant impressed his hearers hear-ers with the fact that he was telling the truth. This morning Howard was recalled for crosexamination. For an hour County Attorney Hanson subjected the witness to a rigid cross exajiiinat ion, hut failed in any way to break down his direct testimony. The only other witness called f..r the defendant this morning wag N. K. Hileman, a former deputy sheriff of Bingham, who identified the knife alleged al-leged to have been in the hand of Yoursk when Howard shot him. |
