Show SMITH JUDGMENT UPHELD BY COURT Decision Awarding Damages Dam-ages as Result of Explosion Explo-sion in This City Affirmed by Supreme Court. The ruling of the lower court is af firmed in an opinion by the Supreme court this morning in the case of Mrs. T. O. Smith, respondent, against the Mine and Smelter Supply company, ap pellant. The appellant sought to have a judgment set aside on the ground that the evidence admitted in the case was not proper and that the court erred in instructing the jury regarding the negligence neg-ligence or the defendant. The opinion, which was by Jnstiee Friek holds that no prejudicial error was made. Mrs. Smith filed the suit to recover damages done to her house bv an explo sion of giant powder that blew up the Oregon tort Line bailding at West Temple and PieTpont streets, several years ago. Mrs. Smith's house was directly south of the place where the explosion occurred. In the lower court Mrs. Smith was awarded a judgment. |
