Show WATER HEARING IN COURT TODAY City's Motion to Dismiss the Temporary Order Restraining Re-straining It From Use of Big Cottonwood Heard. Before Judge Morse of the Third District Dis-trict court, this morning, the hearing of the motion of Salt Lake City to have the temporary order against the city, restraining it from using the waters of Big Cottonwood oreek dismissed, was commended. The hearing was opened by Judge Hiles reading the city's answer to the suit and the motion for the dissolution of the injunction. Judge Hiles asserted that the city had purchased and contracted con-tracted In various ways for the waters of the creek, and that the waters had been secured on rights that were prior to those of the Progress" company. The city then produced three contracts con-tracts with irrigation companies that control the waters of the creek, In which the rights of the water users of the creek had been adjudicated some time in the sixties. City Engineer Kelsey was then placed on the stand to produce maps of the various ditches running from the creek. His evidence was mostly technical and was regarding the amount of flow of the creek and the amount allowed the various vari-ous ditches. Former State Engineer Doremns told of a visit to the Gordon ditch, over which the suit is brought. J. C. Hamilton, Ham-ilton, a farmer of the district, was also called to testify. After hearing his evidence the court adjourned until 2 o'clock. |
