Show SUIT AGAINST 0. S. L. FINALLY DISMISSED In an opinion handed down by the Supreme court this morning the case of William Morgan against the Oregon Short Line Railroad company was reversed re-versed for the second time, and this time the case was ordered dismissed. The action was brought to recover damages dam-ages for the death of the plaintiff's son. John Morgan, who was killed while being be-ing ejected from a freight train near Honeyvllle, June 16, 1901. The Jury returned re-turned a verdict of $500 in favor of the plaintiff. The evidence was to the effect that the train was stopped at the time the boy was ejected and that he was put off without force being used. Further, he was stealing a ride at the time. The court holds that a nonsuit should have been entered, as there was no cause of action. On a former hearing the court reversed the Judgment and ordered a new trial. |
