Ken-' dall, a veterinary surgeon, with having embezzled $660 from the McCoy stable safe on. the night after the election returns re-turns were received, was begun this morning before Judge C. B. Diehl In the criminal division of the City court. ' . Fully a doxen witnesses were sworn In behalf of the prosecution and but one of these. A. S. Kendall, the complainant, complain-ant, was called to the stand this morning. morn-ing. His examination had not been concluded con-cluded at noon, - when an adjournment was taken until this afternoon at 3 o'clock; . ' : - v During the crocs-examlnatton of Kendall, Ken-dall, Attorney A. Snow, conducting the defense, asked Kendall ' If he did not make It his business In addition to being be-ing a veterinary surgeon, to follow the races and to bet on the results. "That is none of your business. I do as I please some of the time." , The court compelled Kendall to answer an-swer the question, which he did In the affirmative. - - It was. alleged by the complainant that he deposited $660 in the safe, under Jensen's safe keeping and care, and that when he called for the money the next day Jensen , declared that some one knowing the combination .to the safe had abstracted the money and some checks belonging to the firm. The checks were afterward found In the rear of the stable. |
