BOARD UPHOLDS PAYNE REFUSAL TO OUST AIDE City Commission Approves Chiefs Chief's Action on Accused Accused Accused Ac Ac- Officer The city c commission voted unanimously unanimously Wednesday to uphold action action of Chief of Police Pollee W. B Hempstead of North Main street The ruling which followed a public hearing ing also ordered that Carlson who has been under temporary suspension suspension sus pension be paid for the time tim he was out of service Hearing progressed after Mr Hempstead Hempstead Hempstead Hemp Hemp- stead an attorney filed a supplementary tary communication citing that the commission had no authority in the case and that jurisdiction is limited to the civil service commission TO HEAR APPEALS The latter body the communication stated is empowered only to hear appeals by officers from action by their superior Commissioner H Harold rold B. B Lee acting chairman asked Mr Hempstead ii if this claim was in effect a w withdrawal of the petition asking dismissal Mr Hempstead replied it was not Fisher Harris cit city attorney acre agre agreed d with Mr Hempstead on the question of jurisdiction but pointed out in this case that the city commission had be been n requested by the chief of police policeto to probe the charges The officer represented by Willard Hanson was called and gave his version version ver ver- sion of his arrest of Mrs Hempstead on a traffic charge on August 26 which resulted in her filing the petition peti petition tion alleging discourteous treatment by Carlson Carison SUPPORTS COLLEAGUE Police Lieutenant E. E A. A Hedman testified for Carlson and in answer to toa toa toa a question if he had seen Carlson use force said that had he been in Carlson's Carlson's Carl Carl- sons son's place he would have used more force than Carlson Carison did Testifying in her own behalf Mrs Hempstead said that she was bruised on both arms arm and shoulders by the officer when he escorted her into the police station Reciting her account of the arrest she said that she was waiting for a place to park as another machine was pulling away from the curb when Carlson Carison arrested her for double park park- tag ing ng E.
