" Warden testified that when Gould struck him he tried to strike back, but was so dazed that he could not land a blow and went into a clinch, the two falling to the floor. He said that Gould lumped up and kicked him iu the side. Within less than thirty minutes after tho case was submitted, the jury hud returned the verdict of guilty. In testifying Gould declared that he had not engaged in any fistic encounters encoun-ters for four years past, saying that he had not had a boxing gloye on in th'it tune, having forsaken the squarrcd circle cir-cle when he suffered a broken nose in a combat. Albert Warden is a Salt Lake youth ot considerable note as a trackat'hlete especially a long distance runner. Ho enlisted in the aerial service of the navy last February. Because of an "unusual number of spectators it became necessary to transfer trans-fer the hearing from the courtroom of Justice Lund to that of Judge Harold M. Stephens of the Third district court. |
