Appeal, from decision of tho commissioner commis-sioner of tho United States geuoral land office to the secretary of tho intorior was taken yestorday by Attorney General Gen-eral A. Ii. Barnes in two important land cases, both, of which involve phosphate laud in l?ich county on stato school sections. Ono of the stiits involves about a dozen claims. In both cases, with the exception of a single claim, the decision of the register and receiver of the local United States Jand offico was against tho state, aud these opinions wero upheld by tho commissioner of the goncral land office. Tho first, case, that of tho state against tho United States Phosphate company, involves sovcral small claims for phosphato in. section .'J2, Rich county. coun-ty. The phosphato company applied) for I tho land in December, 1012, the state protested in January, 1913, and. tho register reg-ister and receiver decided, against the state November, 1913. An appeal was taken to the commissioner, and he affirmed af-firmed tho local land offico officials in a decision rendered March 14, J9M. The other suit is that of the state against B. Bradley and' Eobert. S, Bradley for claims "in section 3(5 of the same territory. Out of about a dozen claims decided) against tho state by the local register and receiver and appealed to tho commissioner, only ono was overruled over-ruled bv that official. This is being appealed to the secretary of the interior by O. F. Davis, attorney for the miu-efal miu-efal applicants. The other decisions arc being appealed from by tho state, |
