Show Out of Twenty-Four Talesmen Examined Thursday, Only Two Jurors Obtained. THREW MORE MEN NEEDED TO COMPLETE THE PANEL Defense-to Make Strong Fight -Against Admittance of Prisoner's Pris-oner's Confession. After exhausting the twelve names on the special venire issued Wednesday, Wednes-day, and also the twelve names on a second special venire issued Thursday morning, only two additional jurors were secured in lite trial of L. 13. Driskell for the murder of Special Policeman Po-liceman C. C. Hilcy, iu Judge Lewis's division of the district court Thursday. Another venire was issued for twenty additional talesmen, who will report for duty this morning, and it is expected ex-pected that the three additional men necessary lo complete tha jury will be secured 'out of that number. A total of twenty-four talesmen wero examined iu the ease Thursday, and of these four were challenged for cause by the state and excused, seven were challenged for cause- by the defense and excused, one was excused ex-cused .upon the second peremptory challenge chal-lenge .by the slate, and four wore excused ex-cused upon peremptory challenges by the defense, while the others were either excused bv the court or were exempt from jury duty. The defense has used seven of its peremptory challenges, chal-lenges, while the state has only used two. Tt is believed that the remaining three jurors will bo secured loday, and that the opening statement by District Attorney Loofbourow will bo" made to the jury and tho taking of testimony commenced late this afternoon. Driskell is being defended by Attorneys Ma-thonihnh Ma-thonihnh Thomas and Dale Parke. Fight Against Confession. The principal light in the case will be the effort, of the defense lo prevent Driskell "s confession of tho murder from beinjr introduced iu evidence. Outside of this confession, it is believed be-lieved that, (he sisrjf.o' has little evidence against Driskell. iiilcy was murdered on State street tii aught of October o last, while lakii.-? l)riskell and his companion to the police station after ho had arrested them upon suspicion of heinir implicated in a hold-up on Second East street shortly before their arrest. Both the prisoners made their escape, but Driskell was captured by the police po-lice a few days afterward, and while in the police station made a complete confession of the crime. After being committed to the county jail he planned to escape, but the scheme was detected in time by Sheriff Sharp, after which Driskell was taken to the state prison for safe keening. Driskell appeared as disinterested in the proceedings in court Thursday as ho did the first day of his trial, and did not seem to be worried in the least as to the outconio of his trial, which, if he is convicted, may mean the death penalty for his offense. m The nine jurors accepted by both sides, in charge of a deputy sheriff, attended and heartily enjoyed the production pro-duction of "The Ensign" Tit the Grand theater, Thursday evening. |
