A fish hatchery was built by Barker across what was onco the natural channel chan-nel of HuntBvlllo Spring creek, and the state secured an injunction against him. The bed of tho stream had changed and tho hatchery was located In the old crock bed, which crosses Barker's property. prop-erty. It was contended by tho stato that the small stream, which still Hows through tho old bed of the creek, was a natural feeding and spawning ground for fish and could not be lawfully obstructod-The obstructod-The lower court found that the diversion diver-sion of the stream had not interfered with its usefulness and that the water In the regular channol still continues to run undiminished and unpolluted.
