Show IMPORTANT MINING SUIT Stockholder Alleges Right to Esamino Both Property and Books. COLORADO SPRINGS, Colo., Oct 13. James P. Burns, former- president of the Portland Gold Mining company, com-pany, petitioned tho District court here today for an alternative writ of mandamus to compel the officers and directors of tho Portland company to permit Mr. Burns 's representative to make a thorough inspection, not only of the company's books and records, but of its mines, reduction works and other property. Judge J. W. Shea ordered tho writ bo returnable on November No-vember 1. In his petition Mr. Burns charges gross mismanagement, approaching exhaustion ex-haustion of the ore reserves in the Portland mines in Cripple Creek, due to the lack of intelligent exploitations, and the existence of ruinous conditions at the Portland mill, in Colorado City. The outcome of this suit is of the utmost importance to mining men all over the world, from the fact that it 13 brought to determine or not whether a stockholder, under the laws of Colorado, Colo-rado, ha9 tho right to go into and examine ex-amine a mine simultaneously with the examination of the books and records of the company involved. Mr. Burns says he will apneal the caso to the Supreme Court of tho United States if necessary, to obtain the end sought. |
